    1. Jurisdiction

      1. The terms and conditions apply for contracts by way of lease transfer of hotel rooms for lodging as well as for further rendered services and supplies of the hotel for the customer (hotel agreement). The term ''hotel agreement'' includes and replaces following terms: lodging, guest accommodation, hotel and hotel room agreement.
      2. Subleasing or additional leasing of the rooms as well as the using the rooms for purposes other than accommodation require prior written agreement of the hotel whereas § 540 para.1 sentence 2 BGB (German Civil Code) are waved if the customer is not a consumer.
      3. Terms and conditions of the customer only apply if it was explicit agreed on before.

    2. Conclusion of contract, partner, limitation

      1. Contracting parties are the hotel and the client. The contract comes about the acceptance of the clients' application through the hotel. The hotel is vacant to confirm the room reservation in text form.
      2. All claims against the hotel come under the statute of limitation in one year with the start of the legal commencement of the limitation period. This does not count for claims for damages and for other claims, if latter is based on deliberate or grossly negligent breach of duty of the hotel.

    3. Performance, prices, payment, offset

      1. The hotel is obliged to have the booked room of the customer ready and to perform to the agreed performance.
      2. The customer is obligated to pay the agreed or current hotel price for the accommodation and all additional services as agreed upon. This counts also for the services which the client ordered directly or of the hotel which are performed by a third party and are disbursed by the hotel.
      3. The agreed prices include the valid taxes and local duties to the point of time of the conclusion of contract. Not included are local duties which are owed by the guest itself pursued the local low for example visitor's tax. For changes of the legal sales tax or new introductions, changes or abolition of local duties the prices will be adjusted also after conclusion of contract. With the contracts of the consumer this only applies if the period between conclusion of contract and performance of contract exceed four months.
      4. The hotel can agree on a later reduction of the number of booked rooms, the services of the hotel or the length of stay of the customer if he wishes to do the named things but the hotel can predicate this by increasing the price for the room and/or the services of the hotel.
      5. Invoices of the hotel without a due date have to be paid within ten days counted from receipt of the invoice without deduction. The hotel can request anytime an immediate payment due claims from the customer. Legal regulations will apply in case of a payment default of the customer. The evidence of a higher damage is for the hotel reserved.
      6. The hotel is entitled to request appropriate cash in advance or security for example a credit card guarantee upon conclusion of the agreement. The amount of the cash in advance and payment dates can be agreed on in the contract in text form. The legal regulations will stay unaffected if there is cash in advance or security services for package tours. Legal regulations will apply in case of payment default.
      7. For cases that are genuinely justified for example arrears of the customer or extensions of the scope of the contract the hotel is entitled to request also after the conclusion of contract a cash in advance or a security service until the start of the stay pursued number 3.6 or to request an increase of the agreed cash in advance or security service in the contract up to the agreed remuneration.
      8. The hotel is also entitled to request a cash in advance or security service of the customer at the beginning or during a stay pursued number 3.6 for consisting and future claims out of the contract insofar as there was not performed something of the numbers 4.6 and/or 3.7.
      9. The customer can only set claims of the hotel off with a indisputable or legally valid claim.

    4. Withdrawal of the customer (cancellation)/ non-utilization of the services of the hotel (No Show)

      1. A withdrawal of the concluded contract with the hotel of the customer is only possible if a right of withdrawal was explicitly agreed on in the contract if another legal right of withdrawal consists or if the hotel agrees explicit on a cancellation of the agreement. The agreement of a right of withdrawal as well as a consent to a cancellation of the agreement need to be made in text form.
      2. If the hotel and client agreed on a certain time for a free withdrawal the client can withdrawal from a contract without causing a claim for payment or damages of the hotel. The right of withdrawal of the client expires if he does not practice his right of withdrawal against to hotel to the agreed time.
      3. If the right of withdrawal is not agreed-upon or if it is expired there is no legal right of withdrawal or notice and if the hotel does not agree on a conclusion of contract then the hotel will keep the claim of agreed remuneration despite the non-utilization of the service. The hotel can credit the income from other leasing of the rooms as well as the saved expenses. If the rooms will not be rented elsewhere then the hotel can estimate the deduction of saved expenses. The customer is obliged to pay at least 90 % of the contractual agreed prices for overnight stays with or without breakfast as well as packages with external services, 70 % for half board and 60 % for full board arrangements. The customer shall be free to provide proof that the aforementioned claim did not arise or that it did not arise to the extent claimed.

    5. Withdrawal of the hotel

      1. If there is an agreement that the customer can step back of the contract for free within a certain period of time then the hotel is entitled in this period to step back from the contract if requests of other customers regarding the contractually reserved rooms and the customer does not waive his right of rescission upon inquiry thereof by the hotel.
      2. If an agreed advanced payment or security service pursuant number 3.6 and/or number 3.7 is not performed after the deadline which the hotel fairly dignified then the hotel is also entitled to step back from the contract.
      3. Furthermore, the hotel is justified to terminate the contract for essentially justified reason, particularly if
        - a higher force or other unforeseen circumstances of the hotel make the fulfillment of the contract impossible;
        - rooms are booked by giving misleading or wrong information of important facts culpably; the identity of the customer, the solvency or the purpose of the stay are essential
        - the hotel has a cause of concern which are reasonable grounds that the service is used to be threatened for a smooth operation of the business, the hotel's reputation and security in public without attribute it to the domain or organizational are of the hotel;
        - the purpose or the reason of the stay is illegal;
        - there is a violation against the above mentioned number 1.2.
      4. The entitled withdrawal of the hotel does not justify the claim of the customer for damages.

    6. Room provision, transfer and return

      1. The customer doe not acquire a claim for the provision of certain rooms, insofar as this was not explicitly agreed.
      2. Booked rooms are available for the customer from 15:00 pm at the agreed arrival date. The customer does not have a claim of a earlier provision.
      3. The rooms have to be available for the hotel at the agreed departure date at 12:00 pm. After that, the hotel can charge due to delayed clearance of the room until 18:00 pm 50 % of the full price (list price), from 18:00 pm 90 %. Contractual claims of the customer are not justified hereby. The customer is at liberty to show the hotel that it incurred no or much lesser claim to use damages.

    7. Haftung des Hotels

      1. Das Hotel haftet für von ihm zu vertretende Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit. Weiterhin haftet es für sonstige Schäden, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung des Hotels beziehungsweise auf einer vorsätzlichen oder fahrlässigen Verletzung von vertragstypischen Pflichten des Hotels beruhen. Einer Pflichtverletzung des Hotels steht die eines gesetzlichen Vertreters oder Erfüllungsgehilfen gleich. Weitergehende Schadensersatzansprüche sind, soweit in dieser Ziffer 7 nicht anderweitig geregelt, ausgeschlossen. Sollten Störungen oder Mängel an den Leistungen des Hotels auftreten, wird das Hotel bei Kenntnis oder auf unverzügliche Rüge des Kunden bemüht sein, für Abhilfe zu sorgen. Der Kunde ist verpflichtet, das ihm Zumutbare beizutragen, um die Störung zu beheben und einen möglichen Schaden gering zu halten.
      2. Für eingebrachte Sachen haftet das Hotel dem Kunden nach den gesetzlichen Bestimmungen. Das Hotel empfiehlt die Nutzung des Hotel- oder Zimmersafes. Sofern der Gast Geld, Wertpapiere und Kostbarkeiten mit einem Wert von mehr als 800 Euro oder sonstige Sachen mit einem Wert von mehr als 3.500 Euro einzubringen wünscht, bedarf dies einer gesonderten Aufbewahrungsvereinbarung mit dem Hotel.
      3. Soweit dem Kunden ein Stellplatz in der Hotelgarage oder auf dem Hotelparkplatz, auch gegen Entgelt, zur Verfügung gestellt wird, kommt dadurch kein Verwahrungsvertrag zustande. Bei Abhandenkommen oder Beschädigung auf dem Hotelgrundstück abgestellter oder rangierter Kraftfahrzeuge und deren Inhalte haftet das Hotel nur nach Maßgabe der vorstehenden Ziffer 7.1, Sätze 1 bis 4.
      4. Weckaufträge werden vom Hotel mit größter Sorgfalt ausgeführt. Nachrichten, Post und Warensendungen für die Gäste werden mit Sorgfalt behandelt. Das Hotel übernimmt die Zustellung, Aufbewahrung und – auf Wunsch – gegen Entgelt die Nachsendung derselben. Das Hotel haftet hierbei nur nach Maßgabe der vorstehenden Ziffer 7.1, Sätze 1 bis 4.

    8. Final provisions

      1. Changes and supplements of the contract, the application acceptance or of this terms and conditions need to be made in text form. Unilateral changes or supplements of the customer are invalid.
      2. Place of performance and payment as well as exclusive jurisdiction - also for check and exchange disputes - in business dealings is Dettingen an der Erms. Provided that a contracting party meets the condition of § 38 para. 2 ZPO and that it has no general jurisdiction in the inland the jurisdiction is Dettingen an der Erms.
      3. German law is valid. The application of the UN purchase right and the conflict of laws is excluded.
      4. If there are individual regulations of the terms and regulations which are or will be invalid, the effectiveness of the remaining regulations will not be affected. Apart from that the legal regulations apply.
